The Fast Answer

You probably owe less time than you think.

Most people assume they need to file every year they missed. In reality, the IRS usually only requires the last six years to bring you current. And criminal cases for unfiled returns are extremely rare, less than 0.01 percent of non-filers.

An in-house Enrolled Agent can pull your IRS records, reconstruct what you owe, and file everything in weeks. No hunting for old paperwork.

6
Years to file, usually. Not decades. Not every year you missed. The IRS's own policy statement sets six years as the standard for current status.
3
Years to claim a refund. If you were owed money on any of the past three tax years, you can still get it. After that, it's gone to the U.S. Treasury.
0.01%
Of non-filers face criminal charges. Nearly all cases are civil, not criminal. Fear of jail is the #1 reason people wait, and it is almost never justified.
25%
Maximum failure-to-file penalty. 5 percent of unpaid tax per month, capped at 25 percent. Filing now, even without paying, cuts this dramatically.
What Happens If You Keep Waiting

The IRS doesn't wait forever. Here's what comes next.

The IRS has a specific escalation path for unfiled returns. Understanding where you are in it makes the choice to file clear.

Substitute for Return (SFR)
The IRS files a return FOR you, using only income they can see. No deductions, no credits, no dependents. Your bill is almost always much higher than it would be if you filed.
Penalties Compound
Failure to file is 5 percent per month, up to 25 percent. Failure to pay adds another 0.5 percent per month. Interest compounds daily. What was small becomes large fast.
Refunds Expire
If you were owed a refund on any return older than three years, that money is gone. Permanently. Filed to the U.S. Treasury. Every year you wait, another refund window closes.
Enforcement Begins
Once an SFR is filed and unpaid, the IRS can begin collections. Wage garnishment. Bank levy. Federal tax lien on your property. Your employer will know.

Here's the twist most people miss.

Filing is what STOPS the escalation. The IRS's harshest tools (SFRs, garnishment, levies) are triggered by NOT filing, not by owing money. Once your returns are filed, penalties freeze in place, resolution options open up, and enforcement pauses while your case is worked.

The people who face the worst outcomes are almost always the people who waited. Filing today, even if you cannot pay a cent, is the single most powerful move you can make.

Something We Need to Say

You've probably been called by everyone.
We know.

Once your name appears on any IRS collections list, national tax relief chains start calling. Aggressive pitches. Big promises. "Settle your debt for pennies on the dollar." Some just keep calling until you answer.

Here is what nobody told you: only Enrolled Agents, CPAs, and tax attorneys are federally licensed to represent you before the IRS. Many national chains that reach out subcontract the actual case work after you sign. You never talk to the same person twice.

Rockwater is different. Two things separate us from every competitor:

In-House Enrolled Agents. Not Contractors.

Every Rockwater case is handled by a licensed Enrolled Agent who works here, sits at our office, and is on our team. Not outsourced. Not subcontracted. Your dedicated Account Executive stays with you from first call through resolution, and your in-house EA takes over the case work once you engage.

24/7 Live Case Monitoring via TaxRock.

Our proprietary IRS monitoring platform gives you the same real-time view of your case as your tax team. Status, IRS activity, alerts, documentation, all in one place, live. Built and owned by Rockwater.

Three IRS-Approved Resolution Paths

Your resolution options.

Once your returns are filed, we handle whatever you actually owe. Your in-house Enrolled Agent recommends the path your finances actually support.

Option 1

Installment Agreement

Best if you can pay some, over time

Monthly payments to the IRS over an agreed period. Rockwater negotiates the lowest defensible monthly payment based on your actual finances, not a formula.

Most Installment Agreements can be set up within weeks of filing.

Option 2

Currently Not Collectible

Best if you cannot pay anything now

The IRS agrees to fully pause collection activity because paying would cause financial hardship. Penalties and interest still accrue, but active collections stop.

CNC status is reviewed periodically as your situation changes.

Option 3

Offer in Compromise

Best if your total debt exceeds your ability to pay

Settlement for less than the full balance. Not everyone qualifies. Rockwater tells you honestly if you do, and never promises "pennies on the dollar."

Approval requires full financial documentation and IRS review.

Common questions.

Honest answers about back taxes and how they get resolved.

How many years of back taxes do I have to file?+
In most cases, the IRS only requires you to file the last six years of returns to be considered current. Older returns are typically not required unless the IRS specifically requests them or you were a business owner with more complex obligations.
Will I go to jail for not filing my taxes?+
Criminal prosecution for unfiled returns is extremely rare. The IRS prosecutes less than 0.01 percent of non-filers each year, and cases almost always involve willful fraud or evasion of large amounts. For the vast majority of people, the risk is financial (penalties and interest), not criminal.
What happens if I don't file my back taxes?+
The IRS may file a Substitute for Return (SFR) on your behalf using only the income they can see. SFRs never include deductions, credits, or dependents, so the tax bill is almost always much higher than it would be if you filed yourself. Once an SFR is filed, collections can begin, including wage garnishment and bank levies.
Can I still get my tax refund if I file late?+
Yes, but only within three years of the original filing deadline. After that, the refund is forfeited to the U.S. Treasury. If you have unfiled returns from the past three years and were owed a refund, you can still recover that money by filing now.
How much are the penalties for not filing?+
The Failure to File penalty is 5 percent of the unpaid tax per month, up to 25 percent maximum. This is ten times more than the Failure to Pay penalty (0.5 percent per month). Filing your returns immediately, even if you cannot pay, dramatically reduces what you owe.
What if I cannot find my old tax records?+
Rockwater handles this. We request Wage and Income Transcripts directly from the IRS, which show every W-2, 1099, and reported income document filed under your Social Security Number. We reconstruct returns from IRS records so you do not need to hunt down old paperwork.
