The Fast Answer

Yes, wage garnishment can be stopped. Here's how fast.

The IRS is required to release a wage garnishment (Form 668-D) once we file the correct paperwork and establish a resolution path. In most cases, an in-house Enrolled Agent at Rockwater can begin the release process within one week of your first call.

No contractors. No case handoffs. No waiting weeks for someone to look at your file.

The IRS Collections Process

Garnishment isn't the first step. But it's not the last, either.

The IRS is the one creditor that does not need a court order to take your money. If you owe the IRS, here is the collections process, and where you are on it right now.

1
CP14 Notice
"You owe us."
First notice from the IRS. Interest and failure-to-pay penalties accrue daily.
2
CP501 or CP503
"We're serious."
Reminder notices. Balance grows every month with penalties and interest.
3
CP504
"Intent to Levy."
Notice of Intent to Levy. The IRS can begin enforcement on state refunds and assets.
4
LT11 / Letter 1058
"Final Notice."
30 days to request a Collection Due Process (CDP) hearing. Miss it, enforcement begins.
5
Garnishment + Levy + Lien
"Enforcement."
Form 668-W to your employer. Bank levy. Federal tax lien. Your employer will know.

How much can the IRS actually take from your paycheck?

Unlike private creditors, the IRS is not limited to 25 percent. Depending on your filing status and dependents, the IRS can leave you with as little as $500 to $1,200 per pay period and take the rest. For most workers, that is 60 to 85 percent of gross pay.

The one thing between you and Stage 5 is Stage 4. File for a Collection Due Process hearing during the 30-day window after the LT11 arrives, and enforcement stops. Miss that window, and Form 668-W can be issued to your employer in as few as 21 days.

Something We Need to Say

You've already been called by everyone. We know.

Since the IRS put your name on the public collections list, your phone hasn't stopped. Emails from companies you have never heard of. Aggressive pitches. Big promises. Some said they can settle your debt "for pennies on the dollar." Some just keep calling.

Here is what nobody told you: only Enrolled Agents, CPAs, and tax attorneys are federally licensed to represent you in front of the IRS. Many national chains that reach out subcontract the actual case work after you sign. You never talk to the same person twice.

Rockwater is different. Two things separate us from every competitor:

In-House Enrolled Agents. Not Contractors.

Every Rockwater case is handled by a licensed Enrolled Agent who works here, sits at our office, and is on our team. Not outsourced. Not subcontracted. Your dedicated Account Executive stays with you from first call through resolution, and your in-house EA takes over the case work once you engage.

24/7 Live Case Monitoring via TaxRock.

Our proprietary IRS monitoring platform gives you the same real-time view of your case as your tax team. Status, IRS activity, alerts, documentation, all in one place, live. Built and owned by Rockwater.

Your first call is with a dedicated Account Executive who reviews your notices, income, and where you are in IRS collections. Free. No obligation.

02

We File Power of Attorney

Within 48 hours, we file Form 2848. The IRS is now required to contact us, not you. The harassment stops.

03

We File to Release the Garnishment

Your in-house Enrolled Agent contacts the IRS to request a Form 668-D release. Most garnishments can be released within one to two weeks once a resolution path is established.

04

We Negotiate Your Resolution

Depending on your finances, one of three resolution paths (see below). You get real-time updates through TaxRock, our IRS monitoring platform.

Three IRS-Approved Resolution Paths

Your resolution options.

Not every case gets the same solution. Your in-house Enrolled Agent recommends the resolution path your finances actually support.

Option 1

Installment Agreement

Best if you can pay some, over time

Monthly payments to the IRS over an agreed period. Rockwater negotiates the lowest defensible monthly payment based on your actual finances, not a formula.

Wage garnishment is typically released once an IA is accepted.

Option 2

Currently Not Collectible

Best if you cannot pay anything now

The IRS agrees to fully pause collection activity because paying would cause financial hardship. Penalties and interest still accrue, but wage garnishment stops.

CNC is reviewed periodically as your situation changes.

Option 3

Offer in Compromise

Best if your total debt exceeds your ability to pay

Settlement for less than the full balance. Not everyone qualifies. Rockwater tells you honestly if you do, and never promises "pennies on the dollar."

Approval requires full financial documentation and IRS review.

Common questions.

Honest answers about IRS wage garnishment and how it gets resolved.

How quickly can an IRS wage garnishment be released?+
Once we file Power of Attorney and establish a resolution path, most wage garnishments can be released within one to two weeks. The exact timeline depends on your IRS assignment (Automated Collection System versus assigned Revenue Officer) and how quickly we can document your financial situation.
How much of my paycheck can the IRS actually take?+
Unlike private creditors capped at 25 percent, the IRS can leave you with as little as $500 to $1,200 per pay period based on your filing status and dependents. For most workers, that is 60 to 85 percent of gross wages.
What is the difference between a CP504 and an LT11 notice?+
A CP504 is a Notice of Intent to Levy on your state tax refund and warns of possible enforcement. An LT11 (or Letter 1058) is the Final Notice of Intent to Levy and grants you 30 days to request a Collection Due Process hearing. LT11 is the notice that opens the door to wage garnishment.
Do I still have to talk to the IRS if I hire Rockwater Tax?+
No. Once Form 2848 (Power of Attorney) is filed, the IRS must contact us, not you. We handle every letter, every phone call, every deadline on your behalf.
Can Rockwater help if I have not filed my tax returns yet?+
Yes. Unfiled returns are usually the first thing to address. Your in-house Enrolled Agent will handle both the compliance filings and the resolution strategy in parallel.
What does it cost to stop a wage garnishment?+
Fees vary by case complexity. If we can help after your free consultation, we follow up with a detailed Statement of Work that outlines scope and cost before you commit. No retainer growing over time. No surprise fees.
