What Happens If You Keep Not Filing

Substitute for Return (SFR)
The IRS files a return FOR you using only income they can see. No deductions, no credits, no dependents. Your bill is almost always dramatically higher than if you had filed yourself.
Penalties Compound
Failure to File is 5 percent per month, up to 25 percent. Add Failure to Pay at 0.5 percent per month. Interest compounds daily on top. What was small becomes large fast.
Refunds Expire
If you were owed a refund on any return older than three years, that money is permanently forfeited to the U.S. Treasury. Every year you wait, another refund window closes.
Enforcement Begins
Once an SFR is filed and unpaid, the IRS can begin collections. Wage garnishment. Bank levy. Federal tax lien on your property. Your employer will know.

Best if you can pay some, over time

Monthly payments to the IRS over an agreed period. Rockwater negotiates the lowest defensible monthly payment based on your actual finances, not a formula.

Most Installment Agreements can be set up within weeks of filing.

Option 2

Currently Not Collectible

Best if you cannot pay anything now

The IRS agrees to fully pause collection activity because paying would cause financial hardship. Penalties and interest still accrue, but active collections stop.

CNC status is reviewed periodically as your situation changes.

Option 3

Offer in Compromise

Best if your total debt exceeds your ability to pay

Settlement for less than the full balance. Not everyone qualifies. Rockwater tells you honestly if you do, and never promises "pennies on the dollar."

What if I don't have my old W-2s or 1099s?+
You do not need them. Rockwater pulls IRS Wage and Income Transcripts directly, which show every W-2, 1099, and other income document filed under your Social Security Number going back roughly 10 years. In most cases, we can reconstruct returns entirely from IRS records without you providing any paperwork.
How many years of unfiled returns do I have to file?+
The IRS typically requires the last six years of returns to consider a taxpayer current. Older years are usually not required unless the IRS has specifically requested them or you had complex business obligations. Your in-house Enrolled Agent identifies exactly which years must be filed for your situation.
What if the IRS already filed a Substitute for Return for me?+
A Substitute for Return (SFR) is the IRS filing a return on your behalf using only reported income, with no deductions, credits, or dependents included. You can (and should) file your own return to replace the SFR. In most cases, filing your own return dramatically reduces the tax owed compared to what the SFR calculated.
What if I was self-employed and don't have income records?+
For income the IRS didn't see (cash payments, unreported self-employment), we help reconstruct using bank statements, deposit records, and industry-standard estimation methods. Your Enrolled Agent handles this reconstruction to keep it defensible if the IRS reviews.
How much are the penalties for not filing?+
The Failure to File penalty is 5 percent of unpaid tax per month, capped at 25 percent. This is ten times worse than the Failure to Pay penalty (0.5 percent per month). Filing your returns immediately, even without paying, dramatically reduces what you owe.
Will I still get my old refunds if I file late?+
Yes, but only for returns filed within three years of the original deadline. If you were owed a refund for any of the past three tax years and haven't filed yet, that money is still recoverable. Older refunds are forfeited permanently to the U.S. Treasury.
